Terms of Service

Please read this document carefully. It contains very important information regarding your rights and obligations, including limitations and exclusions which may apply to you. 


These terms and conditions (“T&Cs”) apply to the purchase and sale of products (“Product” or “Products”) from www.petitematisse.com (the “Website”). By placing an order for such Product(s), you agree to be bound by, and accept, these T&Cs. These T&Cs are subject to change by Petit Matisse (“we”, “us”, “our”, “Petit Matisse”, “Petis”). 


Your use of the Website indicates that you have acknowledged, understood, and agree to adhere to the T&Cs. You should also carefully review our privacy policy before placing an order for our Product(s). 


Definitions

“Client” (“customer”, “you” or “your”) refers to the Client or any person acting on behalf of and with the authority of the Client and/or the “payee”. The “payee” (being the person that either books or pays for the Product(s)) is incorporated into the definition of the Client (and is considered as the Client in addition to the person that wears the Product(s)) regardless of whether they are wearing the Product(s).


“Product” refers to all products supplied on hire by Petite Matisse to the Client in accordance with these T&Cs.


Order Acceptance and Cancellation 

You may purchase your product(s) with us by completing and submitting the order form on the Website. You shall be responsible for ensuring accuracy of all orders. All orders will be deemed to be irrevocable and unconditional upon transmission through the Website, and we shall be entitled, but not obliged, to process such order(s) without your further consent and any further reference or notice to you. 

We reserve the right to accept or decline any and all orders received from or through the Website in our sole and absolute discretion. Our acceptance of your order will take place when a confirmation email is sent to your registered email address with us, at which point a contract will come into existence between you and us. Each fully-paid order accepted by us shall constitute a separate and individual contract governed by these T&Cs (an “Order”). We will assign an order number to your Order when we accept your Order. Please tell us your order number whenever you contact us about your Order. 

If we are unable to process your order, we will inform you about this. This might be due to the following:

  • The product is out of stock;
  • Unexpected limits on our resources for which we could not reasonably plan;
  • A credit reference we have obtained for you does not meet our minimum requirements;
  • We have identified an error in the price and/or description of the product; and/or
  • We are unable to meet a delivery deadline you have specified 

If you have been charged and your Order is cancelled, we will promptly issue a refund to your original form of payment in the amount of the charge and notify you that your order was cancelled. 

The price payable by you for the product shall be the price of the product listed for sale and/or rent as stated at the Website at the time your order is transmitted to us through the Website, and any applicable taxes. All prices are subjected to taxes, unless otherwise stated. We reserve the right to amend the price of any product at any time without giving any reason or prior notice. Please complete payment the moment your order was placed as all unpaid orders will be cancelled automatically after one (1) hour. It is always possible that, despite our best efforts, some of the products we sell may be incorrectly priced. We will normally check prices before accepting your order so that, when the product’s correct price at your order date is less than our stated price at your order state, we will charge the lower amount. If the product’s correct at your order date is higher than the price stated to you, we will contact you for your instructions before we deliver your order. We accept all major credit cards.


All orders are subject to acceptance and availability, and items in your shopping basket are not reserved and may be purchased by other customers.

Petit Matisse offers products for sale that are in stock and available for dispatch from our distribution center. Occasionally however, we may be waiting for shipments from our brands’ suppliers. Consequently you may from time to time be given the possibility of making a Pre-Order Payment for certain items in which case you are able to make a Pre-Order. This will ensure that you receive this item in priority once designer stock has been delivered to Petite Matisse . Petite Matisse will only take Pre-Order purchase for stock that has been scheduled for delivery by a designer supplier. Your rights regarding Advance Purchase are the same as those for any other purchase at Petite Matisse. 

Please be aware that we may be unable to deliver selected Advance Payment merchandise due to production problems or quality check issues identified when we receive an order into stock. In these circumstances we will notify you by email and refund the Advance Payment to your credit/debit card within thirty days of being advised that merchandise has become unavailable.

If you have registered your email address for notification of the arrival of a specific product featured on our Site, we will attempt to notify you by email within 48 hours of the product becoming available on the Site. Please be aware that on occasion certain products that are in particularly high demand will sell out during this period.

Petit Matisse will store a record of your transactions for a minimum of one year.


Information of Products

Changes in Products and Pricing

We are constantly updating and revising our offerings of Products, and we may discontinue Products at any time without notice. All pricing for the Products is subject to change. For all of our prices and Products, we reserve the right to make adjustments due to changing market conditions, Product discontinuation, manufacturer price changes, errors in advertisements, and other extenuating circumstances.

We attempt to be as accurate as possible with Product descriptions and prices. However, we do not warrant that Product descriptions or prices are accurate. In the event that we discover an error in the pricing or description of a Product, we shall have the right to refuse or cancel any orders placed for the Product. We shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit or debit card has been charged.


Product Description and Defects 

We try to be accurate as reasonably possible in our descriptions of products available for purchase and/or rent through the Website. However, our products may vary slightly from their pictures. The images on our Website are for illustrative purposes only. Colours may appear slightly different in reality due to studio lighting conditions, or variances in computer screen calibration. We do not warrant that product descriptions or other content on the Website are accurate, complete, reliable, current or error-free.

You are responsible for ensuring that your sizing measurements are accurate. If you believe you have received a defective item, contact us at contact@petitematisse.com with your order number, and a photograph of the defect.

All defective items are to reach us within three (3) calendar days from dispatch date for orders made in Singapore, or fourteen (14) calendar days for international orders. Products must be unworn, unaltered, in condition it was received and with tags intact. If the replacement piece is no longer in-stock, store credit or a refund will be issued. When store credits are issued, such store credits will expire after two (2) years.  


Incorrect Products 

If you believe you have received an incorrect product, please contact us at contact@petitmatisseworld.com with your order number and a photograph of it. We may ask you to proceed with sending your product back to us, for which your courier charges will be reimbursed. The maximum refund for postage costs will be the costs of the delivery by the least expensive delivery method we offer. For illustration purposes, if we offer a delivery of a product within seven (7) to twenty-one (21) days at one cost but you choose to have the product delivered within a shorter period at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.

Please note that product(s) must be unworn, unwashed, unaltered and with its tags intact. If the correct product is no longer available, store credits or a refund will be issued instead. 


Bounced Parcels 

We’ll be in touch via email and/or phone in the event of a bounced parcel. However, please note that without prejudice to any other right or remedy available to us, we may charge you for storage costs and any further delivery costs, or terminate your Order if you repeatedly fail to take delivery of the product. Bounced parcels that are unclaimed after three (3) months will be deemed as Petite Matisse’s property and no compensation will be offered as sufficient response time has been given.


Payment Terms

Terms of payment are within our sole discretion and, unless otherwise agreed by us in writing, shall be as follows: All orders are subject to verification for security reasons. If you are contacted for verification, you will have 48 hours to complete the verification process. If you do not respond after such time, you will be notified and the order will be canceled and refunded in the original payment method.Charges for shipping and handling will be made in accordance with our then-current shipping policies, as described below. Payments made on debit/credit cards in currency other than SGD Dollars will be calculated using currency conversion on its respective bank on the day of the transaction. You agree that Petite Matisse is not responsible for any credit shortages due to currency conversion rates. 


If you preorder Products, you will be required to pay either the full purchase price or a percentage of the amount due as an initial payment at the time you place your order, exclusive of shipping fees and taxes. In the case of an initial payment, we will charge you the remaining amount due, plus shipping fees, and any taxes or duties owed at such time as the Product is ready for shipment. If your payment information has changed, please contact contact@petitematisse.com with your updated payment information. If the remaining payment cannot be processed, your order will be cancelled, and you will be issued a site credit for any amount that you have paid for that Product. Please be aware that because of the "pre-sale" nature of such transactions, you should expect a wait period of approximately four to six (4 to 6) months between the date you place your order and the date that the Product is ready for shipment. The estimated delivery window will be noted on the Product page of the respective Pre-order Product page.If you order Products available for immediate shipping from our Store, you will be required to pay the full amount due, plus shipping fees and any taxes and/or duties associated with the Product at the time you place your order.


Insurance and Delivery

You will own the goods on and from the later of the point in time when: (a) we receive payment in full, or (b) we deliver the goods to you.

Petite Matisse insures each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfillment by Petit Matisse, and transfer of responsibility in the same way. The goods are your responsibility from the time we deliver them to the address you gave us.

Please note that we aim to dispatch all orders within 24 hours, or 48 hours during sale periods. Delivery times appearing on the Site are estimates and are to be used as a guide only and commence from the date of dispatch. In any event, we will deliver the goods to you within 30 days of the day on which we accept your order. Petit Matisse is not responsible for any delays caused by destination customs clearance processes.

If delivery is delayed by any event outside of our control, we will contact you as soon as possible to let you know and we will take steps to minimize the effect of the delay. Provided we do this, we will not be liable for delays caused by the event, but if there is a risk of substantial delay you may contact us to cancel your order and we will give you a refund for any goods you have paid for but not received.

International orders may be subject to duties and taxes that vary by country, which are to be borne by the recipient.

Petit Matisse is not liable for the postal charges, return shipment costs, customs charges and handling fees incurred should the recipient reject a parcel due to import duties or taxes.

During sale and festive seasons, there may be a delay in deliveries due to the high volume of orders.

 

PACKAGING

The products are packaged so as to respect the standards of transport in force, and to ensure an optimal protection of the products during their delivery. It is requested from the Customer to respect these same standards in the case of a product being returned because of after-sales service or for reasons of suitability. Any damage noted to a product arising from the product not being repackaged properly may lead to an only partial refund, or no refund in the event of the impossibility of resale in its state or in the event of a technical problem indicated having been worsened

 

GIFT WRAPPING

Petite Matisse offers its customers a gift-wrapping service for non-bulky objects, such as clothing and accessories, small toys and small objects of decoration. Bulky or cumbersome objects cannot benefit from a proper gift wrapping.

 

RESPONSIBILITY OF THE CUSTOMER TO CHECK PARCELS UPON RECEPTION

Petite Matisse  reminds customers that it is the responsibility of the Customer to inspect his parcels upon reception in the presence of the deliveryman and to notify the transporter as well as Petite Matisse company of any anomaly (bumps, damage to the parcel, delivery date not conforming to normal times of the parcel delivery…) within two working days. In the case where such elements are not noted on the delivery slip presented to the Customer by the transporter, no complaint related to the state of the parcel can be accepted a posteriori by Smallable.

6. Intellectual Property and Content

All copyright, designs, trademarks and all other intellectual property visible through the Services, including Petite Matisse Software and all HTML and other code contained on our Website and App, is the sole property of Petit Matisse or their respective owners. You are permitted to use the content on the Services only as expressly authorized by Petite Matisse and/or its third party licensors. Any reproduction or redistribution of the above listed Content without permission is prohibited and may result in civil and criminal penalties, where "Content" is defined as data files, graphics, text, photographs, drawings, logos, images, sounds, music, video or audio files on the Website. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, commercially exploit, create derivative works from, transfer, or sell any Content, software, products, or services contained within the Services. You may not use the Services, or any of its Content, to further any commercial purpose, including any advertising or advertising revenue generation activity on your own site(s)

7. Limitation of Liability

In no event shall we or our suppliers have any obligations or liabilities to you or any other person for loss of profits, for loss of business or use, or for incidental, punitive, special or consequential damages, whether based on contract, tort (including negligence), products liability, or any other theory or form of action, even if we have been advised of the possibility thereof, arising out of or in connection with the sale, delivery, or use of the Products or Services. Our sole and entire maximum liability (and the liability of our suppliers) for any reason, and your sole and exclusive remedy for any cause whatsoever, shall be limited to the actual amount paid by you for the Products you have ordered through our Services. Some jurisdictions do not allow the limitation or exclusion of liability for certain damages, so the above limitations and exclusions may not apply to you to the extent such jurisdiction’s law is applicable to your purchase of Products.

Returns & Exchange

Subject to certain conditions and exceptions explained below in this Return Policy, and unless otherwise expressly indicated on a Product’s detail page at the time of purchase, we are pleased to accept timely returns of certain new and unused Products.

Products purchased at full price are eligible for return for a full refund within 28 days from the date that the Product was delivered to you.

Products marked as "Final Sale" cannot be returned or exchanged.

Pre-orders placed across multiple cards will be refunded to the same cards used, regardless of the cards being removed from the site, cards expiring, or updated card information.Your Products must be returned in the original packaging, including any boxes, hangers, garment bags, and other signature packaging materials, including Petit Matisse and designer hanging tags. Other designer packaging such as belts, dust bags, authenticity cards, and leather tags should all be included where provided. If your order did not include the proper packaging please email contact@petitmatisseworld.com.

Any returned Products which are damaged, do not include the packaging materials, soiled, or altered may not be accepted and refunds or credits will not be issued for such returns. Refunds or credits will not be processed until the items are returned and inspected by Petite Matisse. Refunds are generally processed within 4-6 weeks of when the returned item is received at our warehouse. 


Links To Third Party Sites

The Website may contain links to third party websites that are not affiliated with or owned, operated, or controlled by Petit Matisse, including third party payment system providers. You acknowledge and agree that Petit Matisse is not responsible for the content, privacy policies, or practices of such third party websites or any companies owned by them. By using the Website, you expressly relieve Petit Matisse from any and all liability arising from your access and use of any third party website. We encourage you to review the terms and conditions and privacy policies of any third party websites before using them and disclosing your personal data to them. 


Personal Data

We may collect, use and disclose personal data that you provide us to supply the Product(s) to you, process your payment for the Product, to send you newsletters if you have registered to our mailing list, and other specified purposes. 


Updates

We may change any content or material on the Website at any time. Any content or material on the Website may be out of date at any given time, and we are under no obligation to update the Website. We shall not be liable if for any reason the Website, or any portion thereof, is unavailable at any time or for any period. We reserve the right to refuse any and all current or future access to and/or use of the Website without prior notice to you. 

If we decide to change our T&Cs for the Website, we will post the revised T&Cs here and, if appropriate, notify you by email. Please check back frequently to see any updates or changes to our T&Cs. Any changes will not affect any Orders that you have placed, and that we have accepted, prior to the date of the change. Your continued use of the Website indicates your assent to the T&Cs as posted. These T&Cs incorporate our Privacy Policy as may be updated from time to time at www.petitmatisseworld.com


Force Majeure

We shall not be liable for any failure or delay in the performance of this contact for the period such that failure or delay is beyond the reasonable control of both parties and materially affects the performance of any of its obligations under this contract. Force Majeure as referred to in this contract means unforeseeable, unavoidable and insurmountable objective conditions. We shall not be responsible for the delay of shipment of non-delivery of all the goods due to force majeure. Both parties shall make all reasonable efforts to prevent the effect of any non-performance of this contract by an event of force majeure.
